Death certificate - Shiboushindansho

It is a "document certifying the fact of death" issued by a doctor to a patient whom the doctor has examined or treated, and must be submitted as an attachment when a death is reported (Family Registration Act, Article 86, Paragraph 2). A doctor should essentially prepare a death certificate only if he or she is present at the patient's death, but if a patient under his or her care dies from that illness within 24 hours of the patient's last visit, the doctor may issue the death certificate without a medical examination (Medical Practitioners Act, Article 20, proviso). A death certificate certifies the end of a person's legal rights and obligations, but also serves as a source of statistics on the cause of death and serves as a reference for administrative purposes regarding the health and welfare of the nation's citizens.

医師が診察または診療した患者について発行する「死亡の事実を証明する書類」で、死亡の届け出をする場合には、添付書類としてかならず提出しなければならない（戸籍法86条2項）。医師は、本来、患者の死亡に立ち会った場合にのみ死亡診断書を作成すべきものであるが、診療中の患者が、その疾病で最終受診後24時間以内に死亡した場合は、検診しないでも死亡診断書を交付することができることになっている（医師法20条但書）。死亡診断書は、人の法律的権利義務の終止を証明するものであるが、死因統計の資料ともなり、国民の健康、福祉に関する行政の参考となる。
