〘noun〙① A written record of what is said orally. ※Koyasan documents - April 7, 1703 (Genroku 16), Draft record of Amano Shrine Shimosengu "The chief priest of Amano came and announced the details of the Shimosengu on April 7th, and sent it to Kosanji Temple. This is recorded in the records of the annual abbot's office." ② A written document that records the oral statements of the parties to a lawsuit or suspects in criminal proceedings during the Edo period. It was used only by samurai, monks, and priests, and was distinguished from the oral statements of foot soldiers, farmers, and townspeople. ※Joruri Tsukunimebuike (1721) 2 "The corpse was wrapped in straw mats and there was nothing else left, so the young retainers of both families took out their yatate and wrote down their statements one by one." ③ During the Edo period, when a citizen of a domain filed a lawsuit against someone from another domain or territory, the lord of that domain requested the shogunate's magistrate's office to accept the lawsuit. 〘名〙① 口頭で述べることを文章に記したもの。※高野山文書‐元祿一六年(1703)四月七日・天野社下遷宮記録案「天野神主え来る四月七日下遷宮之趣申渡候由、興山寺へ申遣之事、口上書年預坊之記録に有之事」② 江戸時代の刑事訴訟で、訴訟当事者や被疑者の口述を筆記した文章。武士、僧侶、神官に限って用いられたもので、足軽、百姓、町人の口書(くちがき)と区別された。※浄瑠璃・津国女夫池(1721)二「死骸に菰を着せた計外には何も存ぜずと、言ひ分の趣、両家の若党矢立を取出し口上書、一々しるし留めにける」③ 江戸時代、領内の人民が、他支配、他領の者を相手取って訴訟を起こす場合、その領主が幕府の管轄奉行所に対し、訴訟の受理を依頼した文書。添使(そえづかい)口上書。※政普集‐乾(古事類苑・法律五六)「公事訴訟諸願添簡等心得事〈略〉万石以上は家来之口上書可差出」④ ⇒こうじょうしょ(口上書)
