Japanese: 強制わいせつ罪 - きょうせいわいせつざい

The crime of committing obscene acts against men and women aged 13 or over through violence or intimidation (Article 176, first paragraph of the Penal Code, punishment is imprisonment for 6 months to 7 years). It is a crime that violates a person's sexual freedom. The violence or intimidation must be severe enough to make it extremely difficult for the other person to resist. Indecent acts refer to sexual acts other than adultery (sexual intercourse), and therefore the target is not limited to women. From the standpoint of protecting the sexuality of minors, indecent acts against men and women under the age of 13 constitute this crime regardless of whether violence or intimidation is used as the means (Article 176, second paragraph).

13歳以上の男女に対し，暴行または脅迫を加えてわいせつ行為をする罪(刑法176条前段，刑は6ヵ月以上7年以下の懲役)。人の性的自由を侵害する罪である。暴行･脅迫は相手方の反抗を著しく困難にする程度のものであることを必要とする。わいせつ行為とは姦淫(性交)以外の性的行為をいい，このため，その対象は女性に限られない。13歳未満の男女に対するわいせつ行為は，青少年の性的保護の見地から，手段としての暴行･脅迫の有無を問わず本罪が成立する(176条後段)。
