Order to prosecute - Kisomeirei

Japanese: 起訴命令 - きそめいれい

When an order for provisional attachment or provisional disposition has been made, this is an order to the creditor to file a lawsuit to obtain a title of debt for actual execution. It is issued by the court that made the provisional attachment or provisional disposition based on the debtor's request, and if the creditor does not comply with this order, the order for provisional attachment or provisional disposition will be revoked (Civil Procedure Code).

仮差し押さえまたは仮処分の命令がなされた場合に，債権者に対して本執行のための債務名義を得るための訴えの提起を命じるもの。債務者の申し立てに基づいて仮差し押さえまたは仮処分をした裁判所によって発せられ，この命令に債権者が従わない場合には，仮差し押さえまたは仮処分の命令が取り消される (民事訴訟法) 。
