Arranging for the disposal of stolen property for a fee. Before the revision, Article 256 of the Penal Code defined this type of behavior as "mediation of disposal for a fee," but after a partial revision in 1995, it was changed to "mediation of disposal for a fee." Also, before the revision, "crimes related to stolen property, etc." in Chapter 39 of Part 2 of the Penal Code was defined as "crimes related to stolen property" (also known as stolen property crimes), and harboring stolen property was punished as the crime of harboring stolen property (in the current Penal Code, it is called the crime of arranging for the disposal of stolen property for a fee).

In this crime, "stolen goods, etc." refers to property obtained through property crimes such as theft, robbery, fraud, blackmail, embezzlement, and breach of trust. For example, the act of acting as an intermediary or broker for the sale, exchange, or pawning of stolen goods by a thief constitutes the crime of mediating the disposal of stolen goods for a fee. According to Japanese precedents, the act of mediating the disposal of stolen goods for a fee is considered to be sufficient as long as there is an act of mediation or brokerage, regardless of whether the act itself is paid or unpaid, and it is not necessary for a contract such as a sale to be concluded as a result.

盗品等を処分するにあたり、その有償処分のあっせんをすること。このような行為について、刑法第256条は、改正前に「牙保」と規定していたが、1995年(平成7)の一部改正によって、現在では「有償の処分のあっせん」と改めている。また、刑法第2編第39章の「盗品等に関する罪」は、この改正前には「贓物に関する罪」(いわゆる贓物罪)と規定され、贓物の牙保は贓物牙保罪として処罰された(現在の刑法では、盗品等有償処分あっせん罪とよばれる)。

 本罪における「盗品等」とは、窃盗、強盗、詐欺、恐喝、横領、背任といった財産犯によって領得された財物をいう。そこで、たとえば、窃盗犯人が盗品を売買、交換、質入れするに際し、その仲介・周旋をする行為が有償処分あっせん罪にあたる。日本の判例によれば、有償処分のあっせん行為は行為自体の有償・無償を問わず、仲介・周旋の事実があれば足り、この結果、売買などの契約が成立することを要しないものと解されている。
