Raffaele Garofalo

Italian criminal law scholar. Born in Naples to an aristocratic family. He had a career as a lawyer, judge, and other legal practitioner, but also served as a professor of criminal law and criminal procedure at the University of Naples. His main work is Criminology (first published in 1885, second edition in 1891; translated into French, Spanish, Portuguese, American, and other languages), in which he defined crimes that lack altruistic feelings or moral sensitivity as "delitto naturale," and systematized criminal sanctions around this concept.

イタリアの刑事法学者。ナポリで貴族の家柄に生まれた。弁護士，裁判官など法律実務家としての経歴もあるが，ナポリ大学で刑法，刑事訴訟法などの教授も務めた。その主要な業績は，《犯罪学Criminologia》(初版1885,2版1891。フランス，スペイン，ポルトガル，アメリカなどで翻訳された)で，あわれみや誠実さという愛他的感情ないし道徳的感受性に欠ける犯罪を〈自然犯delitto naturale〉とし，この観念を中心として刑事制裁を体系づけた。
