Interpolatio (English spelling)

The term refers to the deletions, alterations, and insertions made by the legislators of the Corpus Juris Juris, especially the Corpus Juris and the Corpus Juris Disciples, to adapt the texts of the previous imperial laws and theories of classical jurists to the legal life and sentiment of the time, in order to make the imperial laws and theories of centuries ago the current law of the Eastern Roman Empire. Such alterations are also called "emblematata triboniani" (tribonian insertions) after Tribonianus, who was the chief editor of the code at the time. In the 19th century and after, the study of the Interpolatio, which seeks to clarify the differences between the Roman law of the Papacy and the law of Justinian, became popular and opened up a new field of study in Roman law.

『ローマ法大全』特に『勅法彙纂』や『学説彙纂』の立法編纂者が幾世紀も前の勅法や古典法学者の学説を東ローマ帝国の現行法とするため，先の勅法とか学説から抜粋した法文を，当時の法生活と法感情に適合させるために行なった削除，変更，挿入をいう。このような改竄 (かいざん) は，当時の法典編纂の最高責任者であったトリボニアヌスの名にちなんで「トリボニアヌスの挿入」 Emblemata Tribonianiとも呼ばれる。 19世紀以降のローマ法研究では，元首政期のローマ法とユスチニアヌス帝法との相違を明らかにしようと努めるインテルポラティオ研究が盛んになり，ローマ法研究に一新局面を切り開くことになった。
