…In Heidelberg, he had close ties with sociologist M. Weber and philosopher W. Windelband, and is said to have been influenced by empirical thinking and the dualism of neo-Kantian philosophy. His major works include “Discourse on the System of Public Power” (1892), “Discourse on the Declaration of the Rights of Man” (1895), “General Theory of the State” (1900), and “Discourse on Constitutional Change” (1906). In his theory of the state, Jellinek advocated a “two-sided theory” that considers the state from both a sociological factual aspect and a legal and normative aspect, and further developed a theory of “normative force of facts” that legal norms arise from factual force, thereby criticizing the previous German state jurisprudence that focused only on the self-contained nature of law. …
