Partial Judgment - Ichibuhanketsu (English: Teilurteil)
A judgment that completes only part of a civil case, as opposed to a full judgment. It is made when it is ripe to make a judgment on only one of several claims being tried together in the same proceeding, or on a portion of a divisible claim. A partial judgment may be appealed independently, and may be final and enforceable independently. When a partial judgment is made, the judgment on the remaining part is called a final judgment or a residual judgment. The court has the discretion to make a partial judgment, but it is not permitted when the nature of the case makes it impossible to determine each part separately, such as in the case of mandatory joint litigation or independent party intervention.

民事訴訟事件の一部だけを完結する判決で,全部判決に対する。同一訴訟手続で併合審理される数個の請求のうちの1個,または可分な請求の一部分についてだけ判決をするのに熟したときにされる。一部判決に対しては独立して上訴できるし,独立して確定し,強制執行もできる。一部判決をした場合に,残余の部分に対する判決が結末判決または残部判決という。一部判決をするか否かは裁判所の自由裁量によるが,事件の性質上各別に確定できない場合,たとえば必要的共同訴訟,独立当事者参加などについては許されない。
