Defect - Kashi

Generally speaking, it refers to a flaw or defect, but in legal terms it refers to some kind of legal defect that does not fully produce the intended legal effect, but rather gives rise to a different effect that compensates for or destroys it (for example, a right to claim damages, a right to cancel, or a right to terminate a contract).

However, in law, it is not simply used in the abstract as "defect." It is used, for example, in terms of defective manifestation of intention (an manifestation of intention made through fraud or duress, which can be revoked under certain conditions), defective possession (possession accompanied by circumstances that prevent the effect of complete possession, such as violence, concealment, malice or negligence), or warranty liability.

一般に、きず・欠点などをさすが、法律上は、意図された法律上の効果を完全に生ぜしめず、それを補い、または覆滅せしめる別の効果（たとえば、損害賠償請求権、取消権、契約解除権など）を生ぜしめるような法律上のなんらかの欠点をいう。

　ただし、法律上は単に抽象的に「瑕疵」として用いられることはなく、たとえば、瑕疵ある意思表示（詐欺・強迫などによってなされた意思表示で、一定の要件のもとに取り消すことができる）、瑕疵ある占有（強暴・隠秘・悪意・過失など、完全な占有としての効果を妨げるような事情を伴った占有）、あるいは、瑕疵担保責任というように用いられる。
