Relative contract - Aitai no keiyaku

...This refers to credit relationships that were not recognized as having the right to sue in the Edo Shogunate's civil court procedures (Deirisuji). The "Kujikata Osadamedegaki" (Civil Affairs Act) specifies three types of credit relationships: "Determination to receive a proportion of contracts with joint judgment documents" (profit and loss accounts between joint business partners), "Theater ticket fees" (profit distribution between the thief and the financier), and "Mujinkin" (contributions and claims for contributions to the Tanomoshikou). All of these were based on "bilateral" contracts based on a strong relationship of trust between the parties involved, but the content of the contracts themselves was considered to be strongly profit-oriented and undesirable from a feudal moral standpoint, so it was considered that there was no need to involve authority even if a dispute arose.

…江戸幕府の民事裁判手続(出入筋（でいりすじ）)において，訴権が認められなかった債権関係をいう。《公事方御定書（くじかたおさだめがき）》は，〈連判証文有之諸請負徳用割合請取候定〉(共同事業者相互間の損益勘定)，〈芝居木戸銭〉(座元･金主間の収益配分)，〈無尽金〉(頼母子講（たのもしこう）の掛金･当り金請求)の3種を規定している。これらはいずれも当事者間の強い信頼関係を基礎とした〈相対（あいたい）〉の契約によるものであり，一方，契約の内容自体，収益的性格が強く封建道徳上好ましからざるものと考えられたため，たとえ紛争が生じても権力が関与する必要はないとされたのである。…
