A term coined by Rudolf von Jhering. It was a satire of 19th century German jurisprudence, which was devoted to "calculation of concepts" while ignoring the purpose of law and the needs of society, and has since been used to criticize jurisprudence that places too much emphasis on logic. In response to this, schools of thought such as "jurisprudence of the object," "jurisprudence of the interest," and "jurisprudence of freedom" were established. However, if one goes too far in the opposite direction, there is a danger that trials will become emotional and arbitrary, undermining legal stability. This excessive tendency has been criticized as "jurisprudence of emotion." "The life of law is not logic but experience," are the words of the American legal scholar Holmes, and it can be said that the direction jurisprudence should take lies in the combination of the intermediate logic and experience between jurisprudence of concepts and jurisprudence of emotion.
