Japanese: 訴額 - そがく

In civil litigation, the rights asserted by the plaintiff and disputed by the defendant are called the subject of the litigation, and the monetary value of the benefit to the plaintiff if the rights are recognized by a court as asserted by the plaintiff is called the amount of the claim. In other words, it is the value of the subject of the litigation, or the value of the subject of the litigation. The amount of the claim is the basis for calculating the amount to be paid as a fee when filing a lawsuit (Article 4, Paragraph 1 of the Law on the Costs of Civil Litigation, etc.). The amount of the claim is also the standard for determining whether the court of first instance will be a summary court or a district court (Article 33, Paragraph 1, Item 1 of the Court Act).

民事訴訟において，原告によって主張され，被告によって争われている権利関係のことを訴訟物というが，この権利関係が原告の主張どおりに判決によって認められた場合に，原告にもたらされる利益を，金銭的に評価した額を訴額という。つまり，訴訟物の価額，または訴訟の目的の価額のことである。　訴額は，訴え提起などのとき手数料として納付すべき額の定算の基礎となる(民事訴訟費用等に関する法律4条1項)。また訴額は第一審の裁判所が，簡易裁判所か地方裁判所かを決める標準にもなる(裁判所法33条1項1号)。
