Hot spring rights

A right similar to a real right to use and dispose of hot springs. It is also called the right to use hot springs, the exclusive right to use hot springs, the right to the outlet, or the right to the source. The right to use hot springs is customarily treated as an independent right, separate from the ownership of the land on which the hot springs gush out, and its transferability is recognized. There are no special provisions in the Civil Code, and the Hot Springs Act (Act No. 125 of 1948) only has the purpose of administrative supervision, so the content of the right to use is entirely regulated by custom. As for the method of public notice, customary practices include dividing the hot spring area into lots and registering them as mineral spring areas, or registering them in a registry kept by hot spring associations or local government offices.

温泉を利用・処分する物権類似の権利。温泉利用権、温泉専用権、湯口(ゆぐち)権、源泉権などともいう。温泉を利用する権利は、温泉がわき出る土地の所有権と切り離して、独立なものとして取り扱う慣行があり、その譲渡性が認められている。民法にも特別な規定がなく、温泉法（昭和23年法律125号）は行政監督を目的としているにすぎないから、その利用権の内容はすべて慣行によって規律されている。公示方法としては、湧出(ゆうしゅつ)地を分筆して、鉱泉地として登記したり、温泉組合、地方官庁などに備えられた登記簿に登録するなどの慣行がある。
