〘名〙① 折り合いをつけること。和睦すること。和解。かよ。※吾妻鏡‐建久元年(1190)一〇月一二日「近江国田根庄務事。早随領家使下知、成和与、可沙汰之由」※源平盛衰記(14C前)三七「和与(ワヨ)して命は生きたれ共」② 財物・権利を無償で譲与すること。中世の慣習ではいったん血縁の者以外の他人に譲与した財物は悔んでも返してもらうことができなかった。※光明寺古文書‐寿永元年(1182)一二月一九日・度会神主某譲状「和与一子之物、無悔返法之故也」③ 中世の訴訟解決法の一つ。幕府の裁許を得る以前に、当事者間で確認しあって和解するもの。和解が成立した際、当事者は各々和与状を作成して互いに交換して幕府裁判所に提出し、幕府の担当奉行はこれに裏封を加え、さらに和与裁許状を発給してこの和解を正式に認可した。和談。※鰐淵寺文書‐弘長三年(1263)八月五日・関東下知状案「任正嘉元年御教書、擬尋決之処、両方令和与云々」
