A school of jurisprudence that sees law as the product of a balance of interests and interprets law from the perspective of balancing interests. It has its roots in Bentham's utilitarianism and Jhering's purposive jurisprudence, and shares with the Free Law Movement its rejection of conceptual jurisprudence. Interests include not only material and personal interests, but also spiritual and social interests. Proposed by the Tübingen School of Heck, Rümelin, and others. → Related article Jähring Source : Heibonsha Encyclopedia About MyPedia Information |
