Realist jurisprudence

This refers to the trend in jurisprudence that seeks to view law as a fact rather than as a norm.

(1) A school of American jurisprudence that emerged in the 1930s under the influence of Holmes, Pound, and others, also known as neo-realism. Its starting point, Jerome Frank's Law and the Modern Spirit (1930), claimed that legal stability was a myth and criticized the objectivity of legal interpretation and, in particular, the objectivity of judges' fact-finding. People who belong to this school include Thurman Arnold, Fred Rodel, and Karl Nickerson Llewellyn (1893-1962).

(2) This refers to Scandinavian legal realism, a school of thought centered around Axel Hägerström (1868-1939) of the University of Uppsala in Sweden, which sought to establish an empirical scientific theory of law. Representatives of this school include Karl Olivecrona (1897-1980) and Alf Ross (1899-1978).

法を規範としてではなく、事実としてとらえようとする法学の潮流をさす。

(1)ホームズ、パウンドなどの影響の下で、1930年代に登場したアメリカ法学の学派で、ネオリアリズムneo-realismともよばれる。その出発点となったジェローム・フランクの『法と現代精神』(1930)は、法的安定性を神話であるとし、法解釈の客観性やとくに裁判官の事実認定の客観性を批判した。この潮流に属するのは、サーマン・アーノルド、フレッド・ローデル、カール・ルウェリンKarl Nickerson Llewellyn(1893―1962)などである。

(2)スウェーデンのウプサラ大学のアクセル・ヘーゲルストレームAxel Hägerström(1868―1939)を中心として、法の経験科学的理論を確立しようとした学派Scandinavian legal realismをさし、代表者はオリベクローナKarl Olivecrona(1897―1980)、ロスAlf Ross(1899―1978)などである。
