Japanese: 運送約款 - うんそうやっかん

Carriers must enter into a large number of transportation contracts. For this reason, standardized general terms and conditions are determined in advance for transportation contracts, and a method is adopted in which many transactions are processed quickly and safely. This is the transportation terms and conditions. Forwarding businesses and general automobile carriers must determine their terms and conditions and obtain approval from the Minister of Transport. The same applies when they change them. When the Minister of Transport approves these terms and conditions, it is necessary that they are not likely to harm the legitimate interests of the public, and that at least matters related to the collection of fares and charges and the responsibilities of forwarding businesses are clearly defined. In addition, the terms and conditions must be posted in an easily visible place in the office, etc. (Articles 21 and 22 of the Forwarding Business Law, Articles 12 and 13 of the Road Transportation Law).

運送人は，大量の運送契約を締結しなければならない。そこで，運送契約においては，定型化された普通約款をあらかじめ定めて，これによって多くの取引を迅速･安全に処理する方式がとられている。これが運送約款である。通運事業者および一般自動車運送業者は，約款を定め，これにつき運輸大臣の認可を受けなければならず，これを変更する場合にも同様であり，運輸大臣がこの約款の認可にあたっては，公衆の正当な利益を害するおそれのないものであること，および少なくとも運賃および料金の収受ならびに通運事業者の責任に関する事項が明確に定められていることが必要であり，また，約款を事務所等において公衆の見やすい個所に掲示しなければならない(通運事業法21,22条，道路運送法12,13条)。
