A person whose business is to enter into a transportation contract with a shipper and undertake transportation. Therefore, he is a merchant (Article 502, Paragraph 4 of the Commercial Code). Depending on the object of transportation, he is classified as a goods carrier or a passenger carrier, and depending on the transportation area, he is classified as a land carrier, a maritime carrier, or an air carrier. Chapter 8 of Part 2 of the Commercial Code, Transportation Business, applies to land carriers, and Chapter 3 of the Commercial Code, Maritime (International Maritime Carriage of Goods Act for ocean-going ships), applies to maritime carriers. 荷送人と運送契約を締結して運送を引き受けることを業とする者。したがって商人である (商法502条4号) 。運送の目的物により物品運送人,旅客運送人に,運送区域により陸上運送人,海上運送人,航空運送人に分けられる。陸上運送人には商法第2編第8章運送営業が,海上運送人には商法第3編海商 (外航船について国際海上物品運送法) が適用される。航空運送人に関してはワルシャワ国際航空運送条約が定められている。
