In a democratic society, ensuring the authority of the law is an extremely important issue, and when carrying out court proceedings, it is necessary to maintain order in the courtroom and uphold the dignity of the trial. For this reason, courts are given court-police powers, and in cases where an excessively violent legal battle is taking place, even the defendant may be removed from the courtroom. In addition, permission from the court is required to take photographs, record audio, or broadcast in the courtroom, and such restrictions also meet the need to maintain order (public trial).

民主社会において，法の権威を確保することはきわめて重要な課題であり，裁判所の手続を進めるに当たっては法廷の秩序を維持し裁判の威信を保持することが求められる。そのために，裁判所には法廷警察権が与えられ，度を越した激しい法廷闘争が演じられるような場合には被告人すら退廷させられることがある。なお，公判廷において写真撮影，録音，あるいは放送をするには裁判所の許可が必要とされるが，そのような規制はこの秩序維持の要請にこたえるものでもある(公開裁判)。
