Social insurance is a mandatory insurance that is implemented by the government by setting the conditions for contributions and benefits through legislation, but its direct operation is often left to independent insurers. In such cases, each insurer, if financially permitted, can independently determine the needs of the insured and provide benefits other than the minimum necessary benefits set out by law. When this is permitted, the benefits that are left to the insurer's discretion within a certain range are called non-statutory benefits, in contrast to the statutory benefits that the government requires all insurers to provide. 社会保険は拠出や給付の条件を国が法律で定めて実施する強制力のある保険であるが,その直接的な運営は独立した保険者にゆだねられることも多い。その場合各保険者は,財政的な事情が許せば,被保険者の必要性を独自に判断して,法律で定められた必要最低限度の給付以外の給付を支給することが可能となる。それが認められている場合,一律に国が全保険者に給付を義務づける法定給付に対して,ある範囲内で保険者の裁量にゆだねられているその他の給付を法定外給付という。
