Japanese: 法廷技術 - ほうていぎじゅつ

In a broad sense, it refers to the factual and legal techniques used in the course of a trial to persuade the judges (professional judges, lay judges, jurors, etc.) and obtain a favorable judgment in one's favor. Therefore, courtroom techniques are an issue in all trial processes, whether civil or criminal, and for both the parties in civil cases (plaintiff, defendant, etc.) and for both the prosecutor and the defendant in criminal cases. However, in a narrower sense, it refers to the defense techniques used in the course of a criminal trial to protect the human rights of the defendant against the prosecution by the prosecutor, who is backed by the powerful power of the state, and to ensure a fair trial.

広い意味では裁判の過程において，裁判をする人(職業裁判官，素人裁判官，陪審員など)を説得し，自分の側に有利な裁判を引き出すための事実上･法律上の技術をさす。したがって，民事･刑事を問わずすべての裁判過程につき，また民事事件の当事者(原告，被告など)双方，刑事事件の検察官側･被告人側双方につき法廷技術が問題となる。しかし狭い意味では，刑事裁判の過程において，強大な国家権力を背景とする検察官の訴追に対して被告人の人権を守り，公正な裁判がなされるようにするための弁護の技術をさす。
