The official name of this law is the "Act on the Protection of Secrets Accompanying the Japan-U.S. Mutual Defense Assistance Agreement, etc.", Law No. 166 of 1954. The "defense secrets" previously protected by this law were changed to "special defense secrets" following a partial amendment to the Self-Defense Forces Law in 2001. "Special defense secrets" are secret information on the structure and performance of weapons, equipment, aircraft, etc. provided to Japan by the United States. As a penalty, it stipulates that "anyone who detects or collects special defense secrets with the intent of using them for purposes that are harmful to the security of our country or by unjust means" will be subject to imprisonment of up to 10 years (Article 3). In addition, the 2001 amendment to the Self-Defense Forces Law stipulates that, excluding "special defense secrets," the Director-General (Minister of Defense) will designate as "defense secrets" any important information that is "not publicly available" and that "particularly needs to be kept secret for the defense of our country," such as information regarding the operations, estimates, and plans of the Self-Defense Forces and radio wave information collected in relation to defense, and stipulates penalties of up to five years in prison for any person "whose job is to handle defense secrets" who leaks a "defense secret" that he or she learns in the course of that job.
