Thumbprint - Boin

Also called a finger seal, a nail seal, or a nail stamp. A seal made by applying ink to the back of the thumb (usually the right) and using it instead of a seal. At the end of the Heian period, documents with thumbprints appeared, which are thought to be a simplified version of a hand seal (applying ink to the palm of the hand). When a seal is required for legal or business purposes, it is common to use a thumbprint instead if a seal is not available. Under current law, thumbprints are permitted as a substitute for notifications or applications in the family register (Article 62 of the Enforcement Regulations of the Family Register Act), and thumbprints are also acceptable for signing and sealing handwritten wills. According to the Criminal Procedure Regulations, when a person other than a public official is required to sign and seal a document, a thumbprint (fingerprint) can be used instead (Article 61 of the same regulations).

指印(ゆびいん)、爪印(つめいん)、爪判(つめばん)ともいう。親指(通常は右)の裏に印肉をつけて印章のかわりに押すこと。平安末期には拇印を押した文書が現れており、これは手印(しゅいん)(手のひらに印肉をつけて押す)の簡略化と考えられる。法律上または取引上押印を要求される場合、印章のないときに拇印で代用することが一般に行われている。現行法上も戸籍上の届け出または申請には拇印で代用することが認められており(戸籍法施行規則62条)、自筆証書による遺言の署名押印の場合も拇印でよいと解される。また刑事訴訟規則によれば、公務員以外の者が署名押印すべき場合には、拇印(指印)で代用できることになっている(同規則61条)。
