A lawsuit that arises incidentally to a civil lawsuit or civil execution, and is conducted as a separate procedure to adjudicate on the propriety of the judgment or execution. It is also called a procedural lawsuit because the subject of the adjudication is a matter of the lawsuit. Examples include a suit for retrial (Civil Procedure Act) and a suit for objection to a claim (Civil Execution Act). 民事訴訟や民事執行に付随して生じる訴訟で，その判決や執行の適否の審判をするために別個の手続で行なわれる訴訟。訴訟上の事項を審判の対象とするため，訴訟訴訟ともいう。再審の訴え (民事訴訟法) ，請求異議の訴え (民事執行法) などがその例である。
