A lawsuit that arises incidentally to a civil lawsuit or civil execution, and is conducted as a separate procedure to adjudicate on the propriety of the judgment or execution. It is also called a procedural lawsuit because the subject of the adjudication is a matter of the lawsuit. Examples include a suit for retrial (Civil Procedure Act) and a suit for objection to a claim (Civil Execution Act).
