Fujiki Lawsuit

Japanese: 藤木訴訟 - ふじきそしょう

This refers collectively to a series of lawsuits filed by Fujiki Iki, a long-term hospitalized patient at the Murayama National Sanatorium in Tokyo, over the denial of her application for public assistance (the First Fujiki Lawsuit), and a lawsuit filed by the same plaintiff seeking payment under the Public Assistance Law for the costs incurred in the lawsuit (the Second Fujiki Lawsuit). In the former case, the plaintiff applied for public assistance to the welfare office in the area where the sanatorium was located, because her husband, who was living with another woman and separated from her, had stopped sending her money. However, her application was rejected on the grounds that, since she was not divorced, she belonged to the same household as her husband and should have received public assistance from the welfare office in the area where her husband was located. She then fought to have the rejection overturned.

東京の国立村山療養所で長期入院中の藤木イキが提起した生活保護適用申請却下処分にかかわる一連の訴訟(第1次藤木訴訟)と，同一原告が，この訴訟に要した訴訟関係費用について生活保護法に基づく給付を求めた訴訟(第2次藤木訴訟)とをあわせていう。前者は，原告が，別居中でしかも他の女性と同棲中の夫からの仕送りが絶えたため，療養所所在地の福祉事務所に生活保護受給申請をしたところ，離婚していないのであるから，夫と同一世帯に属する者として，夫の所在地の福祉事務所で生活保護を受くべきだという理由で却下され，この却下処分の取消しを求めて争った訴訟である。
