Land surrounded by other people's land and with no access to the public road (Civil Code Article 210, Paragraph 1). Also, land that cannot be accessed by the public road unless it passes through a pond, river, or seashore, or land that faces the public road but has a cliff or bank and has a significant difference in elevation from the public road, is treated the same as a cul-de-sac (Civil Code Article 210, Paragraph 2). These lands are called quasi-cul-de-sacs in contrast to cul-de-sacs. The owner of a cul-de-sac has the right to pass through the surrounding land to reach the public road (Civil Code Article 210). The place and method of passage must be selected as minimally necessary for the right-of-way holder and the least damage to other land (Civil Code Article 211, Paragraph 1), but a passage may be opened if necessary (Civil Code Article 211, Paragraph 2). The right-of-way holder must pay compensation for damage caused to other land by passage through other land and the opening of a passage (Civil Code Article 212). A cul-de-sac also occurs when land is divided or part of the land is transferred. In such cases, the owner of the cul-de-sac may only pass through the other divided lots or the remaining land, but is not required to pay compensation (Article 213 of the same law).

他人の土地に囲まれて公路に通じない土地(民法210条1項)。また、池沼・河川または海岸を通るのでなければ公路に通じることができない土地や、公路に面していても崖(がけ)・岸があって公路と著しい高低の差がある土地も袋地と同じように扱われる(同法210条2項)。これらの土地は、袋地に対してとくに準袋地とよばれる。袋地の所有者は公路に出るために周囲の土地を通行する権利がある(同法210条)。通行の場所や方法は、通行権者にとって必要最小限でかつ他の土地のためにもっとも損害の少ないものを選ばなければならない(同法211条1項)が、必要がある場合には通路を開設することができる(同法211条2項)。他の土地の通行および通路の開設によって他の土地に生じた損害に対して通行権者は償金を支払わなければならない(同法212条)。袋地は、土地を分割した場合や土地の一部が譲渡された場合にも生じる。このような場合には、袋地の所有者は他の分割地または残余の土地を通行できるにとどまるが、償金を支払う必要はない(同法213条)。
