This refers to decisions made by the execution court in the case of compulsory execution, and there are the following types: (1) A decision concerning the compulsory auction of real estate in the case of monetary execution, which is a judgment made by the court to realize the actual transfer of possession to the purchaser when the real estate is liquidated to set aside for monetary execution (Article 83 of the Civil Execution Act). It is issued to the debtor and the squatter, and has the effect of a title of debt. Its purpose is to allow the purchaser, the owner, to acquire actual possession in a simpler and more effective manner, without having to go to the trouble of filing a suit for delivery based on ownership, and it is a system to guarantee the credibility of the public liquidation system and to make the effectiveness of monetary execution more certain.

強制執行において執行裁判所の行う決定をさし，次の各種がある。(1)金銭執行の際の不動産に対する強制競売に関するもので，不動産が金銭執行の引当てのため換価された際に，買受人に対する現実の占有移転を実現するために裁判所がする裁判(民事執行法83条)。債務者および不法占拠者を対象にして発せられ，債務名義としての効力を持つ。わざわざ所有権に基づく引渡請求の訴えを提起するまでもなく，より簡便かつ実効的な形で，現実の占有を買受人たる所有権者に取得させることを目的とするもので，公の換価制度の信用を担保し，金銭執行の実効性をより確実にするための制度である。
