French legal scholar and practitioner. Born in Blois in the central north of France, he practiced law before serving as a professor at the Faculty of Law at the University of Paris from 1810 to 1830. His major work, Lectures on Commercial Law (1813-17), has earned him recognition as the founder of modern French commercial law. He also made important contributions to the study of medieval maritime law. In particular, he is known for pointing out the universality, uniformity, immutability, and customary origins of maritime law as distinctive features of maritime law compared to civil law, and for setting the stage for the study of maritime law as a distinct field of law. フランスの法学者,法実務家。中北部のブロアに生まれ,弁護士実務を経て,1810‐30年パリ大学法学部教授。主著《商法講義》(1813‐17)によって,フランス近代商法学の樹立者としての評価を得ている。中世海法史の研究でも重要な業績を残した。とくに,海商法の民法に対する特色として,普遍性,統一性,不動性,慣習起源性を指摘して,独自の法領域としての海商法研究の先鞭をつけたことで有名である。【井上 達夫】
