Aemilius Papinianus

A Roman jurist. He is said to have been from Syria or Africa, but this is uncertain. He is said to have been related by marriage to Emperor Septimius Severus, and as both were disciples of Scaevola, he was highly valued by the emperor. He became Prefect of the Praetorian Guard in 203, but was executed in 212 for not supporting the murder of Geta, the younger brother of Emperor Caracalla. During his time as Prefect of the Praetorian Guard, he produced many influential responses, with Paulus and Ulpian as his advisors. His works include Quaestiones , Responsa , and De Adulteriis . However, his citations in Justinian I's Digesta are relatively few, one-sixth of those of Ulpian and one-third of those of Paul.

古代ローマの法学者。シリアまたはアフリカ出身といわれるが確かでない。皇帝セプティミウス・セウェルスの姻戚(いんせき)ともいわれ、ともにスカエウォラの門弟として、同帝に重用され、203年以来近衛(このえ)総監となるが、212年カラカラ帝の弟ゲタ殺害に賛成しなかったので処刑された。近衛総監のとき、パウルスとウルピアヌスを顧問員として有力な解答responsaを多く発した。著書に『質疑録』Quaestiones、『解答録』Responsa、『姦通(かんつう)論』De Adulteriisなどがある。しかしユスティニアヌス1世の『学説集』Digestaにおける引用は、ウルピアヌスの6分の1、パウルスの3分の1と比較的少ない。
