Japan-China Fisheries Agreement

Following the normalization of diplomatic relations between Japan and China in 1972, the "Agreement on Fisheries between Japan and the People's Republic of China" (Japan-China Fisheries Agreement) was concluded in December 1975, replacing the previous private fisheries agreement. This Japan-China Fisheries Agreement covers the waters east of the "Military Alert Line" set by China at the entrance to the Bohai Sea and the "No Machinery Trawl Line" set along the Chinese coast, as well as the waters of the Yellow Sea and East China Sea north of the "Military Operation Line" near Taiwan (excluding territorial waters), stipulates that the flag state has jurisdiction over violations, and stipulates the establishment of a Japan-China Fisheries Committee, and stipulates in Annex I to the agreement the establishment of fishing moratoriums and protected areas, the number of fishing vessels (a unit for counting set nets, a type of fixed net), and regulatory measures such as restrictions on the brightness of fish-attracting lights, body length, and mesh size, while Annex II stipulates refuge ports, etc.

The Agreement between Japan and the People's Republic of China on Fisheries (Japan-China Fisheries Agreement), signed in 1997, covers Japan's and China's exclusive economic zones, and provides that coastal states have the right to regulate. However, the waters between 30°40' and 27°N, excluding the area up to 52 nautical miles offshore from the two countries, are to be jointly managed as a provisional zone (regulation is the responsibility of the flag state), and a certain area south of 27°N will maintain the previous order in the fishing industry (regulation is the responsibility of the flag state). At a Japan-China ministerial consultation held in Beijing in February 2000, it was agreed that the eastern end of the area north of the provisional zone (north of latitude 30 degrees 40 minutes north) in which fishing could be conducted without mutual permission would be at 127 degrees 30 minutes east longitude and its western end at 124 degrees 45 minutes east, the number of fishing vessels from each country in the exclusive economic zone of the East China Sea in 2000 and 2001, and the agreement would come into effect on June 1, 2000.

1972年(昭和47)の日中国交正常化に伴い、それ以前の民間漁業協定にかわる「日本と中華人民共和国との間の漁業に関する協定」(日中漁業協定)が75年12月に締結された。この日中漁業協定は、適用水域を、中国が渤海(ぼっかい)入口に設定している「軍事警戒ライン」および中国沿岸に設定している「機船底引網禁止ライン」以東で、また台湾付近の「軍事作戦ライン」以北の黄海・東シナ海の水域(領海を除く)とし、違反に対して旗国が管轄権を有すること、日中漁業委員会の設置等を定め、同協定付属書Ⅰで、休漁区・保護区の設定、漁船の統数(定置網の一つである、建て網を数える単位)、集魚灯の光度、体長、網目の制限による規制措置を定め、Ⅱでは避難港等を規定した。

 1997年(平成9)に署名された「漁業に関する日本国と中華人民共和国との間の協定」(日中漁業協定)は、適用水域を日本の排他的経済水域と中国の排他的経済水域とし、規制は沿岸国が取締り権をもつとした。しかし北緯30度40分から27度の海域は、両国から52海里沖合いまでの水域を除いて暫定水域として共同管理し(取締りは旗国)、北緯27度以南の一定海域は従前の漁業秩序を維持する(取締りは旗国)こととされた。2000年2月に北京(ペキン)で開かれた日中閣僚協議で、暫定水域の北側(北緯30度40分以北)で相互に許可なく操業することができる海域の東端を東経127度30分、西端を124度45分とすること、2000年、2001年の東シナ海の排他的経済水域における相手国船の操業隻数、協定発効を2000年6月1日とすること、で合意した。
