Decriminalization

Japanese: ディクリミナリゼーション（英語表記）decriminalization

Decriminalizing acts that were previously considered crimes and making them non-punishable. This is based on the idea that the central function of punishment is social control, and that acts that are suitable for control by legal regulations other than the criminal code (such as civil and administrative sanctions) or social norms other than the law should be excluded from the scope of criminal punishment. Examples of crimes that are often cited as types of decriminalization include crimes that do not clearly involve victims, crimes that are directly linked to religion or ethics, and crimes that are considered excessive or inappropriate to be dealt with by coercive measures such as punishment.

従来犯罪とされてきた行為を非犯罪化し，処罰しないものとすること。刑罰の機能の中心は社会統制であるとし，刑法以外の法的規制(民事･行政制裁など)または法以外の社会規範による統制がふさわしい行為は刑罰の対象からはずすべきであるとの考え方に基づく。非犯罪化の類型として，しばしば挙げられる例は，被害のあることが明白でない犯罪，宗教や倫理に直接結びついている犯罪，刑罰という強制手段で対応するのが過剰または不適切と考えられる犯罪等である。
