Notice disposition - Tsuukokushobun

When tax authorities are convinced of a violation of indirect national taxes, customs duties, tonnage, etc., through an investigation, they notify the violator, explaining the reasons, to pay a fine, a penalty, or confiscated property at a designated location. This is an administrative punishment procedure that does not involve criminal proceedings. The violator is free to carry out the notice or not. If the violator carries out the notice, the disposition will have the same effect as a final judgment, and the violator will not be prosecuted for the same case again. If the notice is not carried out within a certain period of time, or if the violator is unable to carry out the notice or the circumstances are deemed to be such that a prison sentence is necessary, the tax authorities must file charges, which will move the case to the normal criminal proceedings.

間接国税，関税，とん税などの犯則事件の調査によって，税務官庁が犯則の心証を得た場合に，理由を明示して，罰金，科料に相当する金額，没収物などを指定の場所に納付すべき旨を犯則者に通告する行政処分。刑事訴訟手続によらない行政上の科刑手続である。通告の内容を履行するか否かは犯則者の自由である。犯則者が履行したときは，その処分は確定判決と同一の効力を生じ，重ねて同一事件について訴追されない。一定期日内に履行されないとき，または通告しても履行能力がないか，情状が懲役刑にあたるものと認められるときは，税務官庁は告発の手続をしなければならず，これにより通常の刑事訴訟手続に移行する。
