Right of view - Choboken

This refers to the right of the owner or possessor of a structure to be able to enjoy a certain landscape without being disturbed by others. This right is included in the ownership or possession of the structure, and is a right derived from that right, not an independent right. This right is similar to a real right claim or a suit for possession, but it is not a strong and active right, and it only comes into effect when the limit of tolerance is exceeded, and is based on the theory of abuse of rights. The first case in which legal protection of views was recognized was the Sarugakyo Onsen case in Gunma Prefecture, where a tourist inn that depended on the lake view was found to abuse its rights by a rival who maliciously started building a new inn in front of the inn, and an injunction was issued to stop the construction (Tokyo High Court decision, September 11, 1963).

建造物の所有者または占有者が、一定の風景を他に妨害されることなく眺望しうる権能をいう。この権能は、建造物の所有権または占有権中に包含され、その権利より派生する一作用たる権能であり、独立の権利ではない。この権能は、物権的請求権ないしは占有の訴えに類似するが、このような強力で積極的な権能ではなく、受忍限度を越えるときにのみ効力を生ずるものであり、権利濫用の理論が基礎とされる。眺望の法的保護を最初に認めた判例は、群馬県の猿ヶ京温泉事件であり、湖水の眺望を生命とする観光旅館の目の前に、同業者が悪意で新しい旅館の建築に着手したのは権利の濫用であるとして、建築の差止めが認められた（東京高等裁判所判決昭和38年9月11日）。
