Land and Rent Control Order

Japanese: 地代家賃統制令 - ちだいやちんとうせいれい

Imperial Ordinance No. 443 of 1946. The current law aims to stabilize the people's lives by controlling land rents and house rents. It replaced Imperial Ordinance No. 678 of 1940 with the same name. Here, land rent refers to the rent or land rent of land that is leased for the purpose of owning a building or on which a surface right is established, and house rent refers to the rent of a leased building or part of a building (Article 2). The lessor of a leased land or house cannot contract or receive an amount of land rent or house rent that exceeds the suspended control amount (Article 4) or the approved control amount (Article 6) for the leased land or house (Article 3). It became effective as a law on April 28, 1952, according to Law No. 88 of 1952.

昭和 21年勅令 443号。地代および家賃を統制して，国民生活の安定をはかることを目的とする現行の法令。同名の昭和 15年勅令 678号に代ったもの。ここに地代とは，建物を所有する目的で賃借され，または地上権を設定された土地の借賃または地代をいい，家賃とは，賃借せられた建物または建物の一部の借賃をいう (2条) 。借地または借家の貸主は，借地または借家について，停止統制額 (4条) または認可統制額 (6条) をこえて，地代または家賃の額を契約し，または受領することができない (3条) 。昭和 27年法律 88号により，同年4月 28日以後，法律として効力を有した。
