An act in which a warship or military aircraft takes control of a certain ship or aircraft and occupies it. In times of war, warships of a warring nation can seize enemy ships or neutral ships that transport prohibited goods or break a blockade at sea. The captured enemy warships and public ships become spoils of war, while enemy private ships and neutral ships are inspected at their own country's capture inspection station and the disposition is finalized. In times of peace, warships and military aircraft of any nation can seize pirate ships and aircraft on the high seas, regardless of nationality, and bring them to their own country for punishment. In addition, some treaties on high seas fisheries and resource conservation stipulate that competent public officials of all parties may seize violating ships. However, punishment is imposed by the flag state (e.g., the North Pacific High Seas Fisheries Convention and the International Fur Seal Protection Convention). In addition, the seizure and subsequent measures by coastal states in response to fishing violations within the 200-nautical-mile zone are stipulated in treaties or domestic laws (such as the Japan-Russia Offshore Fisheries Agreement and the Law on the Exercise of Sovereign Rights, Including Exclusive Economic Zone Fisheries).

軍艦または軍用航空機などが、一定の船舶または航空機をその支配下に置き占有する行為。戦時には、交戦国の軍艦は、敵国の船舶、あるいは戦時禁制品の輸送、封鎖の侵破などを行った中立国船舶を海上で拿捕することができ、拿捕された敵国軍艦・公船は戦利品となり、敵国私船および中立国船舶は自国の捕獲審検所で検定のうえ処分が確定する。平時においては、いずれの国の軍艦・軍用航空機なども、公海において、国籍のいかんを問わず、海賊船舶・航空機を拿捕し、自国で処罰するために自国に引致することができる。また、公海漁業・資源保存に関する諸条約で、すべての当事国の権限ある公務員が違反船を拿捕しうる旨規定している場合がある。もっとも処罰は旗国が行う(北太平洋公海漁業条約、オットセイ保護条約など)。また、200海里水域内での漁業違反に対する沿岸国による拿捕およびその後の措置が、条約あるいは国内法で規定されている(日ロ地先沖合漁業協定、排他的経済水域漁業等主権的権利行使法など)。
