Crime of arrest and confinement

It is a crime to violate freedom of movement, i.e. freedom of physical activity, by arrest or confinement, and is punishable by imprisonment for three months to seven years (Article 220 of the Penal Code). "Arrest" means exerting direct control over a person's body, and "confinement" means making it impossible or extremely difficult for a person to escape from a certain area. Arrest occurs when a person is held in a headlock or tied with a rope around the hands and feet, while confinement occurs when a person is locked in a room or when they are assaulted or threatened to prevent escape. Confinement can also occur when a person is forced into a car or on the back of a motorcycle and driven at high speed to prevent escape. There was a provision that increased the punishment for the crime of arrest and confinement committed against one's own or one's spouse's direct ascendants (parents, grandparents, etc.), but this was deleted in the 1995 revision of the Penal Code because it was considered to be against equality under the law. Examples of lawful arrest and confinement include (1) arrest, detention, and detention with a warrant in accordance with the procedures set out in the Code of Criminal Procedure, and (2) hospitalization of a mentally disabled person in accordance with the provisions of the Mental Health and Welfare Act.

逮捕または監禁によって行動の自由、すなわち人の身体活動の自由を侵害する罪で、3月以上7年以下の懲役に処せられる(刑法220条)。「逮捕」とは、人の身体に直接的支配を及ぼすことをいい、「監禁」とは人が一定の区域から脱出することを不可能または著しく困難にすることをいう。他人を羽交い絞めにしたり、手足をロープで縛るような場合は逮捕にあたり、部屋に入れ施錠したり、暴行・脅迫して脱出を妨げる場合などが監禁にあたる。自動車の中やオートバイの荷台に乗せ、疾走して脱出できないようにするのも監禁にあたりうる。自己または配偶者の直系尊属(父母や祖父母など)に対して逮捕監禁の罪を犯したときは刑罰を加重する規定があったが、法の下の平等に反するという考えから、1995年(平成7)の刑法改正により削除された。なお、適法な逮捕監禁の例として(1)刑事訴訟法の定める手続により令状をもって逮捕、拘引、拘留する場合、(2)精神保健福祉法の規定により精神障害者を入院措置する場合などがある。
