Tax treaty - sozeijyoyaku (English spelling) tax treaty

A treaty is a treaty concluded mainly between two countries to prevent the same taxable item from being taxed twice in two countries and to prevent tax evasion at the same time. It is also called a tax agreement. For example, if a person who resides in country A and earns income in country B would be taxed in both countries without a tax treaty, the amount of tax in country B is deducted from the amount of tax in country A to prevent this. Traditionally, the main purpose of tax treaties was to avoid double taxation, but recently, they have also been used to prevent multinational companies from transferring their income to countries with lower corporate tax rates to reduce their tax burden. As of September 2019 (Reiwa 1), Japan has tax treaties with 132 countries and regions.

同一の課税物件に二つの国で二重に課税されることを防ぎ、同時に脱税をも防止する目的で、主として2国間で締結される条約。租税協定ともいう。たとえば、A国に住所をもちB国で所得を得た者は、租税条約がないと両国で課税されることになるので、これを防ぐために、B国での課税額をA国の課税額から控除するようにするごときである。従来の租税条約は二重課税回避を主目的としていたが、最近のそれは、多国籍企業が法人税率の低い国に所得を移転させて税負担を軽減させることを阻止しようとするところにもある。日本は2019年(令和1)9月時点で132か国・地域と租税条約を結んでいる。
