Ship Lessee - Demise Charterer

A bareboat charterer is a person who, in a broad sense, leases a ship from another person, but under the Commercial Code, it is a person who leases a ship from another person and uses it for a voyage for the purpose of conducting commercial activities. The Commercial Code provides that when a ship lessee uses a ship that he or she has leased for commercial purposes for a voyage, he or she has the same rights and obligations as a shipowner with respect to matters related to the use of the ship (Article 704). In addition, the lease of a registered ship can be registered, and if registered, it will be effective against those who have acquired real rights in the ship (Article 703).

裸傭船者のことであり，広義には他人の船舶を賃借する者をいうが，商法上では，他人の船舶を賃借し，商行為をなす目的をもってそれを航海の用に供する者をいう。商法は，船舶賃借人が商行為をなす目的で賃借した船舶を航海の用に供したときは，その利用に関する事項については，第三者に対して船舶所有者と同一の権利義務を有する旨を定めている (704条) 。また登記船の賃貸借はこれを登記することができ，登記すれば，その船舶につき物権を取得した者に対してもその効力が生じる (703条) 。
