Living Law - Ikeruho

Legal norms that are supported by the consciousness of the people and govern their actual behavior. A term used by the Austrian legal scholar Ehrlich as opposed to statutory law. Ehrlich argued that this "living law" (lebendes Recht) is the basis of statutory law, and that without it no statutory law would be enacted. He argued that jurisprudence is not just about legal interpretation, which explains the provisions of statutory law, but that sociology of law, which studies this living law, is necessary. In countries like Japan, which inherited legal systems from foreign countries, there is a large discrepancy between statutory law and living law, and pioneers of legal sociology in Japan, under the influence of Ehrlich, tried to adopt living law through surveys of rural customs and other means.

民衆の意識に支えられ、民衆の現実の行動を支配している法規範。オーストリアの法学者エールリヒによって、制定法に対立するものとして用いられたことば。エールリヒは、この「生ける法」lebendes Rechtが制定法の基礎をなすもので、それなしには制定法は行われないとし、制定法の条文を注釈する法解釈ばかりが法学ではなく、この生ける法を研究する法社会学が必要であることを主張した。日本のように外国から法制度を継受した国は、制定法と生ける法とのずれが大きく、日本における法社会学の先駆者たちは、エールリヒの影響下で、農村慣行調査などを通じて生ける法を採用しようとした。
