Rudolf Smend
1882‐1975
German public law scholar and canon law scholar. After 1911, he was professor at the universities of Greifswald, Tübingen, Bonn, and Berlin, but in 1935, he was expelled from the University of Berlin by the Nazi regime and transferred to the University of Göttingen. He is famous for his theory of integration, which applies the concept of integration to state jurisprudence. His dynamic theory of public law, which begins with understanding the state not as a static entity that is the "source" of laws, court decisions, administrative activities, etc., but as a "spiritual reality that exists only in a process of constant renewal and reproduction (integration process)," was in fierce opposition to so-called legal positivist public law in Weimar Germany, on the one hand, and also to Carl Schmitt's decisionism, which also took a critical stance against legal positivism.

ドイツの公法学者,教会法学者。1911年以降グライフスバルト,チュービンゲン,ボン,ベルリンの各大学教授を歴任したが,35年ナチス政権によりベルリン大学を追われ,ゲッティンゲン大学に移籍した。統合Integrationの概念を国法学に応用した統合理論Integrationslehreの提唱者として有名。国家を,法律,裁判判決,行政活動等々の〈源〉たる静態的な存在としてではなく,〈絶えざる更新,再生産の過程(統合過程)の中にのみ存在する精神的現実〉として把握するところから出発するその動態的公法理論は,ワイマール期のドイツにおいて,一方でいわゆる法実証主義的公法学と厳しく対立するとともに,他方では同じく法実証主義批判の立場に立つカール・シュミットの決断主義等とも対立した。
