Laws enforced in colonies. Colonial law takes completely different forms depending on the type of colony: in dependent territories under the sovereignty of the mother country, it is the law of the mother country; in protectorates, it is the protectorate treaty and the laws of the protected country; and in mandated states, it is the Covenant of the League of Nations. Examples of prewar Japan include (1) Taiwan after the First Sino-Japanese War, Sakhalin and Korea after the Russo-Japanese War, and the Southern Military Territory (Area A - the Philippines, Malaya, Java, Sumatra) as dependent territories; (2) Port Arthur and Dalian after the Russo-Japanese War, (3) the former German South Sea Islands after World War I as mandate territories; and (4) Manchukuo, the Wang Jingwei regime, and the Southern Military Territory (Area B - Thailand and French Indochina) as protectorates after the start of the Fifteen Years' War. 植民地において施行される法。植民地法は,植民地の形態に応じて,本国の主権が及ぶ属領では本国法,保護国では保護条約と被保護国の法令,委任統治国では国際連盟規約など,まったく異なった法律形式をとる。 戦前の日本に例をとれば,(1)属領としての日清戦争後の台湾,日露戦争後の樺太や朝鮮,それに南方軍政地域(甲地区――フィリピン,マラヤ,ジャワ,スマトラ),(2)租借地としての日露戦争後の旅順,大連,(3)委任統治としての第1次大戦後の旧ドイツ領南洋群島,(4)保護国としての十五年戦争開始以降の満州国,汪兆銘政権,南方軍政地域(乙地区――タイ,フランス領インドシナ)などがある。
