It is a suit to determine whether a document was created based on the will of the person who is alleged to have created it (Civil Procedure Act, Article 134). For example, let's say that A, who is being pressured by B to return a loan, claims that he has no recollection of borrowing such money and that the consumer loan agreement between A and B that B has in his possession was not created by A's will, resulting in a dispute between A and B. In such a case, B can of course file a suit for the return of the loan, and A can file a suit for a confirmation of non-existence of debt, which is actually the norm, but A can also seek confirmation that the consumer loan agreement was not created by A's will (and vice versa when B files a lawsuit).

書面が，作成者と主張されている者の意思に基づいて作成されたかどうかを確定する訴えをいう(民事訴訟法134条)。たとえば，Bから貸金の返還を迫られているAは，そのような金を借りた覚えはなく，Bが所持しているAB間の消費貸借契約書はAの意思によって作成されたものではないと主張して，AB間に紛争が生じているとしよう。このような場合に，Bが貸金返還の訴えを提起したり，Aが債務不存在確認の訴えを提起することは，もちろんできるし，むしろそれが普通であるが，Aが消費貸借契約書がみずからの意思で作成されたものでないこと(Bが訴えるときはその逆)の確認を求めることもできる。
