法律行為に条件が付された場合において,条件の成就の成否が未定の間,条件の成就によって一定の利益(権利)を受けることへの当事者の一方の有する期待ないし期待的地位をいう。期待権の一種である。たとえば,甲が乙に対し,将来乙が結婚すれば甲所有の特定の家屋を贈与するとの約束をした場合,この贈与契約は,乙の結婚という事実が発生するまではその効力を生ぜず(停止条件付法律行為),乙は条件が成就したときにはじめて甲の家屋についての権利を取得することができる。
