In criminal trials, post-indictment procedures are centered on the offense and defense of both parties (prosecutor, defendant, and defense attorney) at the trial date (party principle). To ensure a fulfilling trial, it is desirable to act based on careful advance preparation, rather than reacting on the spot. This is also extremely important for realizing intensive trials. For this reason, the preparations made by the parties to the trial before the first trial date are called advance preparations. The prosecutor organizes and checks the investigative materials, draws up a plan of proof, and holds meetings with the defense attorney.

刑事訴訟において，起訴後の手続は公判期日における当事者(検察官と被告人，弁護人)双方の攻撃防御を軸に進められていく(当事者主義)。その審理を充実したものとするためには，その場その場の対応によるのではなく，事前の周到な準備に基づく活動が望まれる。集中審理を実現するためにも，これはきわめて大切なことである。このために訴訟関係人が第1回公判期日前に行う訴訟の準備が事前準備である。　検察官は，捜査の資料を整理･点検して立証計画をたてるとともに，弁護人との打合せを行う。
