A service mark is a mark used by a person who provides a service as a business, rather than selling goods, in order to distinguish the service he or she provides from that of others. These marks are known as service marks. Examples include advertising, finance and insurance, real estate transactions, construction and repair, communications, transportation and storage of goods, processing of goods, education and entertainment, and other businesses such as restaurants, hotels, and medical care. Service marks have become important with the development of the tertiary industry, and were first protected by a registration system in the United States under the Trademark Act in 1946.
