Judicial norms are rules that judges must follow to resolve disputes. In contrast, codes of conduct are norms that govern the behavior of people in society at large. For example, moral norms such as "Thou shalt not kill" and "Thou shalt not steal," as well as customs and manners, are codes of conduct. Generally, norms are thought to command or prohibit people from engaging in certain actions, but whereas judicial norms instruct judges in trials to command or prohibit certain actions, codes of conduct command or prohibit ordinary people in social life from engaging in certain actions. 裁判規範とは,裁判官が紛争解決のためにしたがうべき準則である。これに対して,行為規範は一般社会における人間間の行為を規律する規範である。たとえば〈殺すなかれ〉〈盗むなかれ〉のような道徳規範や,また習俗,マナーなどは行為規範である。一般に,規範は,人に一定の行為を命令しまたは禁止すると考えられるが,裁判規範が裁判における裁判官に一定の行為の命令または禁止を指令するのに対し,行為規範は社会生活における通常人に一定の行為を命じまたは禁ずるものである。
