This refers to family trees, memorial tablets, Buddhist altars, gravestones, graveyards, etc. used for ancestral festivals. These are separated from general inheritance property and are not subject to joint inheritance. If the deceased designates a person to preside over ancestral festivals, then the person will inherit the ritual property. The designation does not have to be in a will or other form and can be made verbally. If there is no designation, then the person who should preside over ancestral festivals according to custom will inherit the property. If the custom is unclear, the family court will determine the succession of rights to the ritual property (Civil Code Article 897, Paragraph 2). 祖先の祭りのために使用される家系図,位牌,仏壇,墓碑,墓地などをいう。これは一般の相続財産と切り離され,共同相続の対象とはされない。祭祀財産は被相続人が祖先の祭祀を主宰すべき者を指定するときは,その者が承継する。指定は遺言などの方式に限られず,口頭でもよい。この指定がないときは,慣習に従って祖先の祭祀を主宰すべき者が承継する。慣習が明らかでないときは,家庭裁判所が祭祀財産の権利の承継を定める(民法897条2項)。
