Property district - Zaisanku

A special local government entity. It refers to a part of a city, town, village, or special ward that owns property (mountain forests, wilderness, pastures, hot springs, fishing rights, etc.) or has public facilities (public halls, community centers, etc.), or in the case of the consolidation or boundary change of a city, town, village, or special ward, a part of the city, town, village, or special ward owns property or has public facilities based on the consultation of the relevant city, town, village, etc. (Local Autonomy Law, Article 294). A property district is a special local government entity with legal personality (Article 1-2, Paragraph 3 and Article 2, Paragraph 1 of the same law), and has the authority to manage, dispose of, or abolish its property, etc., but usually the mayor and assembly of the city, town, village, etc. in which the property is located are the executive and decision-making bodies (Article 294, Paragraph 1 of the same law). However, if there is a special need, a special assembly or general meeting of the property district can be established by ordinance to decide on the management, disposal, or abolition of the property, etc.

特別地方公共団体の一つ。市町村および特別区の一部が財産（山林・原野牧野・温泉・漁業権等）を有しもしくは公の施設（公会堂・公民館等）を設けているもの、または、市町村および特別区の整理統合もしくは境界変更の場合において、関係市町村等の協議に基づき、市町村および特別区の一部が財産を有しもしくは公の施設を設けるものをいう（地方自治法294条）。財産区は、法人格を有する特別地方公共団体であり（同法1条の2第3項・2条第1項）、その財産等の管理および処分または廃止についての権能をもつが、通例、その財産が存する市町村等の長および議会がその執行機関および議決機関となる（同法294条1項）。ただし、とくに必要がある場合は、条例によって財産区固有の議会または総会を設けて、その財産等の管理・処分・廃止について議決させることができる。
