A contract in which a worker promises to perform labor services for an employer and the employer promises to pay the worker remuneration (Article 623 of the Civil Code). It is one of the typical contracts stipulated in the Civil Code, and, like contracting and commissioning, is a contract to use the labor of others, but it is characterized by the fact that the worker provides labor under the direction and command of the employer. Employment contracts under the Civil Code are considered to be contracts made on an equal footing between the worker and employer, but in reality, workers are placed in a disadvantageous position. Therefore, the law intervenes in the content of the contract, such as wages and working hours, and consideration is given to ensuring that the worker and employer are as close to equal as possible when making the contract. 労働者が使用者に対して労務に服することを約し,使用者が労働者にその報酬を支払うことを約する契約(民法623条)。民法の定める典型契約の一つで,請負,委任とともに他人の労務を利用する契約であるが,使用者の指揮命令のもとで労働者が労務を提供する点に特徴がある。民法上の雇傭契約では,労働者と使用者は対等な立場でなされる契約ととらえているが,現実には,労働者が不利な立場にたたされている。そこで,賃金や労働時間など契約の中身に法が介在し,労働者と使用者ができる限り対等に近い立場で契約できるよう配慮されている。
